Harvest Art Gallery, LLC is one of the premier sources for contemporary photography, art and framed vintage vinyl records. Harvest Art Gallery, LLC’s use of information that we collect from individuals through our website www.harvestartgallery.com is described in this privacy policy (“Policy”). By ordering product(s) from us, communicating with us, signing up for our mailing list or visiting our website, you agree to our collecting information as we’ve described it in this Policy. If you have signed up to receive information from us, you can always change your mind, see the Opting Out section below. You may have other rights that relate to your information that is in our possession as described in more detail below.
Personal information We Collect
We collect information from you when you provide it to us and/or when you visit, use or navigate our website. Visitors are free to navigate our website without providing us with any personal information; however, see Log Files and Cookies That Collect Information Autonomously for information that we collect without your affirmatively providing it to us. If you want to make a purchase from us, you can make your purchase as a guest or you can create an account to facilitate other purchases from us. Whether you create an account or purchase as a guest, you will be asked to provide your first and last name, email address and a phone number. Account holders will also be asked to create a password. Our payment processor will collect additional information from you that is needed to process your purchase. This may include the credit card or payment account holder’s name, account number, expiration date, CVV, billing address/zip code associated with the card, shipping address, name of recipient, phone number and email address. We currently use Shopify to host our website and process payments; their privacy policy describes how they collect and use your information which may differ from what we do. If you are interested in receiving information, updates, links to our blog, and promotional offers about our products and our business generally, you can sign up on our website for our email list or check the box on the order form at the time of purchase indicating that you want to receive communications from us. We will ask for your name and email, or if you are making a purchase and indicate that you want to receive communications from us, we will add the name and email from your ordering information to our email list. If you do not want to receive information from us, do not check the box. You can change your mind at any time and opt-out of our email list if you no longer want to receive our emails; see Opting Out below if you want to change your communication preferences.
The information you provide to us is stored on servers that we own or that are provided by third party services that we contract with. The information you provide to our payment processor is stored on servers owned or controlled by them and not Harvest Art Gallery, LLC.
If you post a review on our site, any of our social media sites or the site of any third party we use in the course of marketing and selling our products or maintaining our website, you agree that we can use the review in whole or in part, with or without attribution to the name under which it was posted, in our marketing and advertising and may edit it, republish it and/or reach out to you for further information. If you post a review to a third party site, their privacy policy will also govern how your review can be used.
Our website and social media pages may contain links to websites operated by third parties. Our Policy does not apply to these third parties and the information they may collect from you if you visit their websites or how they use that information. The privacy policies of the linked websites should explain what they collect and how they use it. We have no responsibility for the actions, omissions or policies of such third parties.
Log Files and Cookies That Collect Information Autonomously
“Cookies” refer to software code, including web beacons, pixel tags, and log files, that is placed on your phone, tablet, computer or other device (“Device”) in the course of your visiting, using or navigating our website (and websites generally), and when you upload or download information. We, our payment processor, and/or third parties that provide us with website hosting, administration, analytics and other services, use cookies and other technologies to track your use and navigation of our website and in some cases the particular pages and products or services that you view.
The information collected automatically from your Device may include information about the browser, device and the Internet Service Provider (ISP) you use, the Internet Protocol (IP) addresses involved in your connection to the website, the URL you were at before coming to our website, details about your visit (e.g., what you view, how long you view it or what you click on), your location, and date and time. We and our third party service providers may access and collect this information when it is available even though you have not affirmatively provided it to us. Most of this aggregated information is anonymized and we are not able to personally identify users.
We use third parties, including social media influencers, to market and promote our business and our products. If you click on a link on one of these sites that directs you to our site and you place an order, our practice is to compensate the third party whose site you visited before landing on our site. To do this, we track certain sites and if you came to our site from one of them, we will track any order that you place.
We and our third party service providers use this autonomously collected information to do some or all of the following: administer the website, analyze how visitors navigate the website, provide users with more relevant content, improve the usability, functionality and content of our website and our services, compensate third parties who we have contracted with to market our products, and also to provide technical and customer service.

How We Use The Information We Collect

It is used to track what products you place in your cart before they are ordered. For order processing, billing, record keeping, legal, compliance and auditing purposes, we may retain and use your information after we have responded to your request or after fulfillment of an order you placed. We may also use it to communicate with our payment processor. If you create an account, we will keep the information until you deactivate your account, or depending on the laws of the state where you live, until you request that we delete your information. You also have the option to have our payment processor retain your payment information to facilitate future purchases. We or a third party we use to help us obtain information about our customers’ experiences, may use your email and/or purchase information to contact you and ask you to review your purchase. And we may use your information to communicate with third parties involved in fulfilling your order, processing payment for it and/or responding to any questions you may have.
We may also use the information in the context of the social media presence that we maintain. The information may also be used by us to develop future marketing and advertising, and in promotional and product development planning.

Reviews
If you make a purchase, you may be asked to review the product you ordered and your experience in buying from us. The request for a review may come from us directly or through a third party (e.g., Shopify). You may also generally comment on your experience using our website or on our products without having made a purchase. If you post a review, you grant us an irrevocable, perpetual, transferable license to use the review, including all text, pictures and images, in whole or in part, with or without the name under which the review was posted, and to edit the review and use it in marketing, advertising and promoting our products and business in any media, including on our website and/or social media sites and in any third party media or on any other websites. By posting a review, you represent and warrant that you are at least 18 years of age, own all content in the review (i.e., text, images, pictures), have the right to post them to our or our partners’ website(s), and have the sole right to grant the licenses granted herein.

Our payment processor collects information needed to process payment for your purchase(s). As described above, we use third parties to host and administer our website and in the course of the work they do for us, or to prevent fraud or misuse of our website, these third parties may access the information that we have collected, including your information.
If a third party were to purchase us or merge our company with theirs, or in the course of negotiating a purchase or merger of our business, we may need to disclose your personal information to the purchaser or prospective purchaser and to transfer your information to the purchaser if such a purchase or merger were to be concluded. We may allow third parties to provide us with analytics and other information about people’s access and use of our website. Opting Out

You will not be able to opt out and we will not be able to delete any information pursuant to a request if you have a purchase that is pending.

The information we or our third party service providers collect from you is stored on servers that we or they maintain in the United States and/or Canada.

We use one or more third parties to administer and host our website and that administrator(s)/hoster(s) is obligated to use industry standard protocols and software to reduce the risk of loss, unauthorized access, disclosure, or misuse of your personal information. However, no data is 100% secure, and we are not able to provide any assurances that the information that we collect and store will be secure or that it will not be subject to loss, unauthorized access, use or disclosure.
Children/Use of our Website
Our website is intended for consumers 18 years and older who are U.S. residents. We do not market to or knowingly collect information from children under 13.
